1. Introduction

These Terms of Use apply to your access and use of the Butterfield mobile app, website, customer rewards program, online ordering features, wholesale portal, staff portal, manager portal, director portal and any related Butterfield digital services.

By creating an account or using the app, you agree to these Terms of Use.

If you do not agree, you must not use the app.

2. App Use

The Butterfield app may allow users to:

  • Create a customer account
  • Place orders
  • View products
  • Earn and redeem rewards
  • Use a personal QR code
  • Track loyalty points and coffee stamps
  • Access wholesale ordering features
  • Access staff, manager or director features where authorised
  • Receive notifications and updates

Some features may only be available to approved users or specific account roles.

3. Accounts

You are responsible for keeping your account login details secure.

You agree to:

  • Provide accurate information
  • Keep your account details updated
  • Not share your login details
  • Not access another person’s account
  • Notify us if you suspect unauthorised access
  • Use the app only for lawful purposes

Butterfield may suspend or terminate accounts that are misused, fraudulent, inactive, abusive or in breach of these Terms.

4. Customer QR Codes and Rewards

Each customer QR code is personal to that customer account.

You must not:

  • Share your QR code with others
  • Use another customer’s QR code
  • Attempt to manipulate loyalty stamps or points
  • Create fake accounts to gain rewards
  • Abuse promotions or app features

Butterfield may adjust, reverse or remove loyalty points, coffee stamps or rewards if they were added incorrectly, fraudulently or due to a cancelled, refunded or invalid order.

5. Loyalty Program

Butterfield may offer loyalty points, coffee rewards, birthday offers, app credits, discounts or other promotions.

Rewards and offers are subject to availability and may change at any time.

Unless stated otherwise:

  • Rewards are not transferable
  • Rewards cannot be exchanged for cash
  • Rewards may expire
  • Rewards may be limited to selected products
  • Rewards may be removed if an order is cancelled or refunded
  • Promotions cannot always be combined

Butterfield may update, pause or end the loyalty program at any time.

6. Orders

When placing an order through the app, you agree to provide accurate order, contact and pick-up or delivery details.

Butterfield may refuse, cancel or refund an order where:

  • A product is unavailable
  • Payment fails
  • The order appears fraudulent
  • Incorrect pricing or product information was displayed
  • Delivery or pick-up cannot be completed
  • The order breaches these Terms

7. Payments

Payments for physical products such as cookies, coffee, drinks, catering or wholesale orders may be processed through third-party payment providers.

By making a payment, you agree to the terms of the relevant payment provider.

Butterfield is not responsible for delays, errors or issues caused by third-party payment systems, except where required by law.

8. Refunds and Cancellations

Refunds and cancellations are handled at Butterfield’s discretion and in accordance with Australian Consumer Law.

Due to the fresh and perishable nature of our products, refunds may not be available for change of mind, incorrect customer details, missed pick-up times or issues outside our control.

Nothing in these Terms limits your rights under Australian Consumer Law.

9. Wholesale Portal

Wholesale access is only available to approved business customers.

Wholesale customers agree to:

  • Provide accurate business details
  • Follow order cut-off times
  • Pay invoices or accounts when due
  • Use wholesale pricing only for approved business purposes
  • Not share wholesale pricing or access with unauthorised parties

Butterfield may approve, reject, suspend or remove wholesale access at any time.

Wholesale pricing, product availability, delivery days, minimum order amounts and account terms may change from time to time.

10. Staff, Manager and Director Portals

Staff, manager and director features are only for authorised Butterfield users.

Authorised users must not:

  • Share internal login details
  • Access information outside their role
  • Misuse customer, staff or business data
  • Edit records without permission
  • Copy, download or disclose confidential information
  • Interfere with app systems or permissions

Butterfield may monitor internal app activity for security, compliance, training and business operations.

11. Confidential Information

Staff, managers, directors, wholesale users and authorised account holders may access confidential information through the app.

Confidential information may include:

  • Recipes
  • Product details
  • Pricing
  • Supplier information
  • Customer information
  • Staff information
  • Business systems
  • Internal procedures
  • Sales data
  • Wholesale pricing
  • Marketing plans

You must not copy, share, disclose or misuse confidential information unless authorised by Butterfield.

12. Acceptable Use

You must not use the app to:

  • Break any law
  • Commit fraud
  • Harass or abuse others
  • Upload harmful content
  • Interfere with app security
  • Reverse engineer the app
  • Copy or misuse Butterfield branding
  • Attempt unauthorised access
  • Scrape, copy or extract app data
  • Damage the app or business operations

We may restrict, suspend or terminate access if these rules are breached.

13. Intellectual Property

All Butterfield branding, logos, designs, images, product names, content, app layouts, graphics, recipes, systems and materials are owned by Butterfield or used with permission.

You must not copy, reproduce, modify, distribute or use Butterfield intellectual property without written permission.

14. App Availability

We aim to keep the app available and working properly, but we do not guarantee that it will always be uninterrupted, error-free or available.

The app may be affected by:

  • Maintenance
  • Internet issues
  • Device issues
  • Third-party service outages
  • Software bugs
  • Payment provider issues
  • POS or integration issues

Butterfield is not liable for temporary app downtime, except where required by law.

15. Changes to the App

Butterfield may update, change, pause or remove app features at any time.

This may include changes to:

  • Rewards
  • Loyalty points
  • Products
  • Pricing
  • Ordering features
  • Wholesale access
  • Staff features
  • App design
  • Account permissions

16. User Content

If the app allows you to upload photos, profile images, reviews, notes or other content, you are responsible for what you upload.

You must not upload content that is:

  • Offensive
  • False or misleading
  • Illegal
  • Infringing
  • Harmful
  • Abusive
  • Inappropriate

Butterfield may remove content that breaches these Terms.

17. Privacy

Your use of the app is also governed by our Privacy Policy.

By using the app, you agree that Butterfield may collect, use and handle your information in accordance with the Privacy Policy.

18. Account Deletion and Termination

You may delete your account through the app where available or by contacting Butterfield.

Butterfield may suspend or terminate your access if:

  • You breach these Terms
  • Your account is misused
  • Your access is no longer authorised
  • Fraud or suspicious activity is detected
  • Required by law or business operations

Some records may be retained where required for legal, accounting, fraud prevention, dispute resolution or business purposes.

19. Limitation of Liability

To the maximum extent permitted by law, Butterfield is not liable for indirect, incidental, special or consequential loss arising from your use of the app.

Nothing in these Terms excludes, restricts or modifies any rights you may have under Australian Consumer Law or other laws that cannot be excluded.

20. Australian Consumer Law

Nothing in these Terms limits your rights under Australian Consumer Law.

If products or services are faulty, not as described, unsafe or otherwise fail to meet consumer guarantees, you may be entitled to a remedy under Australian law.

21. Changes to These Terms

We may update these Terms from time to time.

The latest version will be available through the app or website. Continued use of the app after changes are made means you accept the updated Terms.

22. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes will be handled in the courts or tribunals of New South Wales, unless another jurisdiction applies by law.
